Terms of Service

These Terms and Conditions (“Terms”) govern your access to and use of the SafetyNet.pet website, applications, and services (collectively, the “Service”) operated by Guardianimals LLC (“Guardianimals,” “we,” “us,” or “our”). By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. DEFINITIONS
“SafetyPlan” means the profile of information you create describing your pets, their care needs, and your designated contacts.

“SafetyCheck” means a scheduled SMS check-in message sent to you at times you configure.

“SafetyNet activation” means the escalation process triggered when you do not respond to a SafetyCheck within the applicable window, or when you manually activate it.

“SafetySitter” means a person you designate to be notified and to act on your behalf using your SafetyPlan during a SafetyNet activation.

“Account” means your registered user account on the Service.

2. ELIGIBILITY
You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that the information you provide is accurate and current.

3. ACCOUNTS
You are responsible for safeguarding your account credentials and for all activity under your account. You agree to provide accurate contact information – including a valid mobile number capable of receiving SMS – and to keep it current. The Service depends on the accuracy of the contact information you provide; outdated or incorrect information may cause SafetyChecks or alerts to fail. Notify us promptly of any unauthorized use of your account.

4. DESCRIPTION OF THE SERVICE
The Service allows you to build a SafetyPlan, schedule SafetyChecks, designate SafetySitters, and have alerts escalated to those SafetySitters if you do not respond to a SafetyCheck or if you manually activate a SafetyNet. Specific features available to you depend on your subscription plan.

We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify you of material changes that affect paid features.

5. NOT AN EMERGENCY SERVICE – IMPORTANT SAFETY DISCLAIMER
Please read this section carefully. It is fundamental to your use of the Service.

The Service is a convenience and notification tool. It is not an emergency service, a monitoring service, a medical service, a veterinary service, or a substitute for any of these. It does not guarantee the safety, health, or wellbeing of you, your pets, or any other person or animal.

The Service does not contact emergency services, law enforcement, animal control, veterinarians, or any first responder. Escalation is limited to notifying the SafetySitters you designate. Whether and how a SafetySitter responds is entirely outside our control.

SafetyChecks and alerts are delivered as SMS text messages over third-party cellular carrier networks. Message delivery is not guaranteed and may be delayed, filtered, blocked, or fail entirely due to carrier conditions, device settings, signal availability, number portability, regulatory filtering, or other factors beyond our control.

The Service relies on you responding accurately and on time, on the accuracy of the information in your SafetyPlan, and on the availability and willingness of your designated SafetySitters to act. We are not responsible for outcomes resulting from missed, delayed, or failed messages, from your failure to respond, from inaccurate SafetyPlan information, or from any action or inaction of a SafetySitter.

Do not rely on the Service as your sole safeguard for any situation where a pet’s life, health, or safety may be at risk. Maintain independent arrangements for the care of your pets.

If you or an animal is experiencing an emergency, contact your local emergency services, veterinarian, or animal control directly.

6. SMS AND MESSAGING TERMS
By providing a mobile number and enabling SafetyChecks or alerts, you consent to receive recurring automated SMS messages from the Service at that number, including scheduled SafetyChecks and escalation alerts. Message frequency depends on the schedules you configure.

Message and data rates may apply, depending on your mobile carrier and plan.

You can reply STOP to opt out of messages and HELP for assistance. Opting out of messages will disable SafetyChecks and alerts and will prevent the Service from functioning as intended.

You represent that you are the subscriber or authorized user of any mobile number you register, and that any SafetySitter you designate has consented to receive alert messages at the number you provide for them. You are responsible for obtaining each SafetySitter’s consent to be contacted.

Carriers are not liable for delayed or undelivered messages.

7. SUBSCRIPTIONS, PLANS, AND BILLING
The Service offers a free tier and paid subscription plans. Current plan names, features, and pricing are described on our pricing page and are incorporated into these Terms by reference. Paid plans are billed through our third-party payment processor, Stripe.

Billing. Paid subscriptions are billed in advance on a monthly or annual cycle, as selected at checkout. Annual subscriptions are offered at a discount relative to monthly billing, as shown on the pricing page.

Renewal. Subscriptions renew automatically at the end of each billing cycle until cancelled.

Plan changes. If you change plans mid-cycle, the change takes effect immediately and your charges are prorated accordingly.

Cancellation. You may cancel at any time. Cancellation takes effect at the end of your current billing period, and you retain access to paid features until then.

30-day money-back guarantee. If you are not satisfied with a paid subscription, you may request a full refund within thirty (30) days of your initial paid subscription by sending us a message at the contact address in Section 20. You may optionally tell us the reason the Service did not meet your needs. This guarantee applies only to your first paid subscription. Outside this 30-day window, we do not provide prorated or partial refunds for the unused portion of a billing period except where required by law.

Downgrades. Downgrading from a higher plan may pause or disable features tied to the higher plan (for example, scheduled SafetyChecks). Paused features are not automatically re-enabled if you later upgrade; you may need to re-enable them manually.

Failed payments. If a renewal payment fails, we may suspend or downgrade your paid features. We may retry payment and notify you per our payment processor’s standard handling.

Price changes. We may change pricing. We will provide reasonable notice before a price change affects your renewal.

8. YOUR SAFETYSITTERS AND DESIGNATED CONTACTS
You are solely responsible for selecting your SafetySitters, for the accuracy of their contact information, for obtaining their consent to be contacted, and for any arrangements or agreements between you and them. SafetySitters are not our employees, agents, or contractors, and we do not vet, supervise, instruct, or guarantee the conduct of any SafetySitter. We have no control over, and are not responsible for, any act or omission of a SafetySitter, including any failure to respond, any delay in responding, or any action taken or not taken during a SafetyNet activation.

To protect the privacy of our users, we cannot provide information about, or access to, any account or SafetyPlan to any person who has not been designated by the account owner as a SafetySitter for that account.

9. ACCEPTABLE USE
You agree not to:

– use the Service for any unlawful purpose or in violation of any applicable law or regulation, including telecommunications and anti-spam laws;
– register phone numbers you are not authorized to use, or designate contacts without their consent;
– attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the Service or its underlying systems;
– use the Service to transmit harmful, harassing, or fraudulent content; or
– resell, sublicense, or commercially exploit the Service without our written permission.

We may suspend or terminate accounts that violate this section.

10. INTELLECTUAL PROPERTY
The Service, including its software, design, text, and branding (including the “SafetyNet.pet,” “SafetyPlan,” “SafetyCheck,” “SafetyNet,” and “SafetySitter” names and marks), is owned by Guardianimals LLC or its licensors and is protected by intellectual property laws. We claim common-law and other rights in our names and marks, whether or not registered, and reserve all such rights. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You retain ownership of the content and data you submit; you grant us a license to use that content solely to operate and provide the Service.

11. THIRD-PARTY SERVICES
The Service relies on third-party providers, including but not limited to Stripe (payments), Twilio (SMS delivery), and other infrastructure providers. Your use of features powered by these providers may be subject to their terms. We are not responsible for the acts, omissions, availability, or performance of any third-party provider, including failures or delays in message delivery or payment processing.

12. PRIVACY
Our collection and use of personal information is described in our Privacy Policy at https://safetynet.pet/privacy_policy, which is incorporated into these Terms by reference.

13. DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR THAT MESSAGES WILL BE DELIVERED. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR ACHIEVE ANY PARTICULAR OUTCOME, INCLUDING THE SAFETY OF ANY PERSON OR ANIMAL.

14. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GUARDIANIMALS LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FOR ANY INJURY TO, ILLNESS OF, OR DEATH OF ANY PERSON OR ANIMAL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE – INCLUDING ANY FAILURE, DELAY, OR NON-DELIVERY OF A SAFETYCHECK OR ALERT, ANY ACT OR OMISSION OF A SAFETYSITTER, OR ANY THIRD-PARTY SERVICE FAILURE – WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

15. INDEMNIFICATION
You agree to indemnify and hold harmless Guardianimals LLC and its owners, officers, and employees from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your violation of these Terms, your designation of or arrangements with any SafetySitter, or your violation of any law or the rights of any third party (including any contact you register without consent).

16. TERMINATION
We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. You may stop using the Service and cancel your subscription at any time per Section 7. Provisions that by their nature should survive termination (including Sections 10, 13, 14, 15, and 19) will survive.

17. CHANGES TO THESE TERMS
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by posting the updated Terms with a new “Last updated” date or by notifying you). Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

18. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Wake County, North Carolina, and you consent to the personal jurisdiction of those courts.

19. MISCELLANEOUS
Entire agreement. These Terms, together with the Privacy Policy and any plan terms shown at checkout, constitute the entire agreement between you and us regarding the Service.

Severability. If any provision is found unenforceable, the remaining provisions remain in effect.

No waiver. Our failure to enforce any provision is not a waiver of it.

Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets of which you would be notified at your email address on record.
